Unlawful Transmission of Classified Information: Air National Guardsman Indicted

A member of the U.S. Air National Guard (USANG) stationed in Massachusetts has been indicted for unlawfully retaining and transmitting classified national defense information on a social media platform. Jack Douglas Teixeira, 21, of North Dighton, Massachusetts, faces six counts of willful retention and transmission of classified information relating to the national defense. Teixeira was arrested in April 2023 and remains in federal custody.

The indictment alleges that Teixeira, who held a Top Secret security clearance, willfully retained and transmitted classified information classified as "TOP SECRET" or "SECRET" and/or Sensitive Compartmented Information on a social media platform to unauthorized recipients. The charges state that Teixeira accessed classified documents from a classified workstation at the Otis USANG Base and transcribed and transmitted the information in written form to other users on the social media platform. Additionally, he posted images of classified documents, bearing standard classification markings, on the same platform.

Attorney General Merrick B. Garland emphasized the gravity of the charges, stating that Teixeira violated U.S. law and endangered national security by sharing classified information with unauthorized individuals. FBI Director Christopher Wray expressed the commitment of the FBI and its partners to hold accountable those who endanger national security, while Acting U.S. Attorney Joshua S. Levy stressed the importance of safeguarding classified information entrusted to individuals.

Each charge of unauthorized retention and transmission of national defense information carries a maximum sentence of up to 10 years in prison, three years of supervised release, and a fine of up to $250,000. The case is being investigated by the FBI, and Assistant U.S. Attorneys and Trial Attorneys from the National Security Division's Counterintelligence and Export Control Section are prosecuting the case.

Austin III approved a tasking memo from the Department of Defense (DoD) Foreign Military Sales (FMS) Tiger Team that highlights six key FMS pressure points and directs implementation of recommendations to improve and accelerate the Department's institutional processes to execute FMS cases. The efforts of the Tiger Team and the Department's commitment to improving the FMS system advance the direction of the 2022 National Defense Strategy to break down barriers to working with allies and partners.

The Tiger Team conducted a thorough analysis of representative case studies, examining all phases of the FMS process. They illuminated best practices to benchmark and identified systemic challenges endemic in the DoD's FMS ecosystem. Additionally, they solicited and incorporated feedback from allies, partner nations, and U.S. industry to enhance the efficiency of DoD's implementation of the FMS process.

Secretary Austin has instructed FMS-implementing agencies to undertake several crucial initiatives:

Former soldier sentenced to 30 years in prison for sexual abuse of young children on military bases including Joint Base Lewis-McChord

Raped two children under the age of 12

Tacoma – A 40-year-old former soldier was sentenced Thursday, June 8, 2023, to thirty years in prison for raping two young children, announced U.S. Attorney Nick Brown. Lewis Patrick Thompson was arrested in July 2020 and pleaded guilty in October 2022. U.S. District Judge Robert J. Bryan ordered Thompson to be on lifetime supervised release following the prison term.

According to records filed in the case, the sexual assaults on the young children occurred on military bases overseas and in the U.S. The assaults occurred when Thompson was serving as a caregiver for the children.

The children disclosed the abuse to trusted adults when they were 11 years old. Both the Army Criminal Investigation Division (CID) and the FBI moved quickly to investigate the matter. Thompson has been incarcerated at the Federal Detention Center at SeaTac, Washington since the arrest.

At a future hearing, Judge Bryan will determine the amount of restitution Thompson must pay to the victims for the counseling and care they require due to the abuse.

The case was prosecuted by Assistant United States Attorney Matt Hampton.

Former U.S. Air Force Officer Sentenced: Unveiling the Breach of National Security Secrets

Former U.S. Air Force Lieutenant Colonel, Robert L. Birchum, was sentenced to three years in federal prison and fined $25,000 by U.S. District Judge Kathryn Kimball Mizelle in Tampa, FL. Birchum pleaded guilty to unlawfully possessing and retaining classified documents related to national defense on February 21, 2023.

During his 29-year career in the Air Force, Birchum held various intelligence positions, working with classified information for prominent agencies such as the Joint Special Operations Command and the Office of the Director of National Intelligence. Despite having entered into agreements to protect classified information, Birchum violated these obligations.

In 2017, law enforcement discovered that Birchum had knowingly taken over 300 classified files and documents, including more than 30 labeled as Top Secret, from authorized locations. He stored these materials in unauthorized places such as his home, overseas officer's quarters, and a storage pod in his driveway. Among the confiscated items were two documents on a thumb drive found at Birchum's residence, containing sensitive information about the National Security Agency's capabilities, collection methods, and vulnerabilities of targets. Both documents were classified as Top Secret/SCI, and their unauthorized release posed a grave threat to national security.

U.S. Attorney Roger Handberg emphasized the serious risk that Birchum's actions posed to national security, thanking law enforcement partners for their commitment to safeguarding the nation. FBI Tampa Special Agent in Charge David Walker highlighted the FBI's dedication to protecting the secrets of the U.S. Intelligence community and ensuring the security of the country.

The case was investigated by the U.S. Air Force Office of Special Investigations and the FBI. Assistant U.S. Attorney Cherie L. "Russia has continued to wage a brutal, completely unprovoked war against Ukraine, launching yet more airstrikes and bombarding Ukrainian cities across the country," stated National Security Council spokesman John F. Kirby during a briefing at the White House.

Russian aggression has included 17 separate air assaults on Ukraine's capital, Kyiv, in May alone, causing harm to civilians and critical civilian infrastructure. In light of these attacks, the United States is committed to providing Ukraine with the necessary support to enhance its defense capabilities.

The security assistance package includes additional munitions for Patriot air defense systems, Avenger air defense systems, Stinger antiaircraft systems, and AIM-7 missiles for air defense.
